Announcement on Issuing the Detailed Rules for the  Implementation of the Registration Administration of Foreign Suppliers of  Imported Solid Waste That Can Be Used as Raw Materials

According to the Measures for the Inspection,  Quarantine, Supervision and Administration of Imported Solid Waste That Can  Be Used as Raw Materials, the General Administration of Customs formulated  the Detailed Rules for the Implementation of the Registration Administration  of Foreign Suppliers of Imported Solid Waste That Can Be Used as Raw  Materials, which are hereby issued with effect from August 1, 2018.

Thereupon, the Detailed Rules for the Implementation of  the Registration Administration of Foreign Suppliers of Imported Solid Waste  That Can Be Used as Raw Materials (Issued by Announcement No. 98 [2009] of  the former General Administration of Quality Supervision, Inspection and  Quarantine) shall be repealed.

Detailed Rules for the Implementation of the  Registration Administration of Foreign Suppliers of Imported Solid Waste That  Can Be Used as Raw Materials


Chapter I General Provisions


Article 1 For the purposes of strengthening and  regulating the registration and supervisory administration of foreign  suppliers (hereinafter referred to as the “suppliers”) of imported solid  waste that can be used as raw materials (hereinafter referred to as the  “waste raw materials”), these Detailed Rules are developed according to the  Regulations for the Implementation of the Law of the People's Republic of  China on Import and Export Commodity Inspection and the Measures for the  Inspection, Quarantine, Supervision and Administration of Imported Solid  Waste That Can Be Used as Raw Materials.


Article 2 These Detailed Rules shall apply to such  matters as acceptance, examination, approval and supervisory administration  of the application from foreign suppliers for the registration of imported  waste raw materials.


Article 3 The General Administration of Customs  (“GACC”) shall be responsible for the acceptance, examination, approval and  supervisory administration of the application from foreign suppliers for the  registration of imported waste raw materials.


Article 4 The Suppliers of imported waste raw  materials shall, prior to the signing of trade contracts, obtain the  registration.


Article 5 An applicant for supplier registration  shall meet the following conditions:


(1) Lawfully qualifying for operations in the country  (region) where it is located;


(2) Having a permanent office space and corresponding  infrastructure in the country (region) where it is located;


(3) Familiar with and abiding by the laws and  regulations, and relevant standards issued by China in relation to entry and  exit inspection and quarantine, environmental protection, and solid waste  management;


(4) Obtaining the certification of ISO9001 Quality  Management System or RIOS System;


(5) Having measures and capabilities for environmental  quality control of the waste raw materials supplied so as to ensure that the  supplied waste raw materials meet the mandatory requirements of the national  technical specifications issued by China in relation to entry and exit  inspection and quarantine, environmental protection, and solid waste  management.


(6) Having radioactive detection equipment, facilities  and testing capabilities;


(7) Having no such severe problems relating to safety,  hygiene, environmental protection and fraud within the recent 3 years.


Chapter II Acceptance, Examination and Approval


Article 6 An applicant shall submit an application  for registration through the regulatory system for inspection and quarantine  of inbound goods and file the following written materials to the GACC within  30 calendar days after the successful online submission of the application  for registration:


(1) A registration application generated and printed  through the application system (see Annex 1);


(2) The notarized tax registration documents, and the  notarized commercial registration documents, if there are commercial  registration documents;


(3) The explanation for the functions of the  organizational structure, departments and posts;


(4) The plan of the fixed office with an indication of  the size, and a plan of the processing workshop, if any, and 3 or more photos  that can comprehensively show the real view of the aforesaid office and  processing workshop;


(5) The color photocopy of the authentication  certificate of the ISO9001 quality management system or RIOS system; and


(6) The original power of attorney and the photocopies  of the identifications of both client and entrusted party shall be submitted,  where an application for registration is filed by an entrusted agent.

Where written materials are submitted, a Chinese  version or a Chinese-English bilingual version shall be used.


Article 7 The GACC shall, according to the  following cases, respectively process the applications for registration  submitted by applicants:


(1) If the written materials are incomplete or not in  the statutory form, the applicant shall be informed of all the supplements  and corrections as required at a time on the spot, or within five days after  receiving the written materials, and notified that the applicant makes  supplements and corrections within 30 calendar days. If the applicant is not  thus informed, acceptance shall be granted on the date of receipt of the  written materials.


(2) If the application materials are complete and in  the statutory form, or the applicant submits all the supplements and  corrections as required by the GACC in the statutory form, acceptance shall  be granted;


(3) If no supplements and corrections are made within  the prescribed time limit, processing of the registration shall be  terminated, and the applicant shall be notified in writing;


(4) If no supplements and corrections are made as  required, or the application materials remain not in the statutory form upon  supplements and corrections, the application shall be rejected and the  applicant shall be notified in writing.
